1. Acceptance of Terms
These Terms of Service govern the relationship between VON Visual Designs ("we," "us," or "our") and individuals or businesses using our website design and development services ("you" or "the client").
By accepting a project proposal, agreeing to a project agreement, or purchasing our services, you acknowledge that you have read and agreed to the applicable terms. Merely visiting our website does not mean you have agreed to purchase services.
If you do not agree to these terms, do not purchase or proceed with our services.
2. Our Services
VON Visual Designs provides website design and development services. Websites are built using code and may use technologies such as HTML, CSS, JavaScript, and other appropriate tools.
Depending on the agreed project scope, services may include:
- Custom website layouts and visual design.
- Responsive desktop, tablet, and mobile layouts.
- Website navigation, buttons, and interactive features.
- Forms, integrations, and other agreed functionality.
- Website deployment or setup, when included in the project.
Every project is different. Specific pages, features, deliverables, deadlines, and prices will be established through the applicable project agreement or written proposal.
3. Pricing and Payments
The price and payment schedule for a project will be communicated before the client commits to the work. Deposits, milestone payments, and final payment deadlines will be specified in the project agreement when applicable.
- Additional work outside the agreed scope may cost extra.
- Work may be paused when agreed payments are overdue.
- Third-party fees are not included unless expressly stated.
- Any new charges must be communicated and approved before the additional work begins.
Applicable taxes and payment processing fees will be handled as disclosed in the project terms and as required by law.
4. Revisions and Changes
The number of included revisions, if any, will be agreed upon for each project. A revision generally means an adjustment to an existing design or agreed feature.
New pages, major redesigns, additional integrations, or changes to previously approved requirements may be treated as additional work and may require a new quote.
We will communicate significant changes to the cost or scope before proceeding with the extra work.
5. Hosting and Domains
A website may require web hosting, a domain name, or other services to be accessible online. These services may be provided by independent third-party companies.
Unless hosting or domain registration is specifically included in the project agreement, the client is responsible for obtaining and maintaining these services and paying their associated fees.
We cannot guarantee uninterrupted service from third-party hosting providers or domain registrars.
6. Online Stores and Payment Processing
Online stores and websites that accept payments may require additional integrations and services, such as PayPal or another compatible payment processor.
Depending on the project, a complete store may also require hosting, a database, order management, inventory tools, checkout functionality, and other infrastructure. These are not automatically included in every website.
The client is responsible for:
- Creating and maintaining required payment processor accounts.
- Paying applicable transaction fees and subscriptions.
- Managing products, orders, refunds, and customer service.
- Handling applicable taxes and legal obligations for their business.
- Following the payment provider's rules and policies.
VON Visual Designs does not act as a bank or payment processor. Payment processing is subject to the provider's approval, availability, and terms.
7. GitHub and Public Source Code
VON Visual Designs uses GitHub to store and manage website code. Project repositories may be public. A public repository can allow other people to view, download, copy, or reuse its contents.
Clients should not assume that source code stored in a public repository is confidential or exclusive to them. Copyright, applicable licenses, and third-party rights continue to apply.
Private repositories or alternative arrangements must be discussed before the project begins and may involve additional costs or limitations.
We will take reasonable care not to intentionally publish confidential credentials. Clients must never place passwords, API keys, payment credentials, or other sensitive information in a public repository.
8. Ownership and Licensing
Ownership and permitted use of the final website, custom code, designs, graphics, and other deliverables will be established in the applicable project agreement.
Payment alone does not necessarily transfer every intellectual property right. Clients should review their project agreement to understand what rights they receive and which files will be delivered.
Third-party libraries, frameworks, fonts, images, and other assets remain subject to their own licenses. Any license applied to a public repository may affect how its contents can be reused.
9. Client Responsibilities
The client agrees to:
- Provide accurate information and timely project feedback.
- Provide content and materials they have permission to use.
- Review project work and communicate requested changes.
- Maintain required third-party accounts when applicable.
- Ensure their business practices and website content comply with applicable laws.
Clients must not use our services to facilitate fraud, unlawful activities, or infringement of another person's rights. Delays in receiving required content, feedback, or approvals may affect project timelines.
10. Third-Party Services
Websites may depend on external services, including GitHub, hosting providers, domain registrars, payment processors, APIs, and other software platforms.
We do not control these providers and cannot guarantee their continued availability, pricing, policies, or performance. We are not responsible for independent service interruptions or account restrictions imposed by third parties, except where applicable law provides otherwise.
Clients are responsible for reviewing the terms and requirements of services they use directly.
11. Delivery, Maintenance, and Support
Deliverables and estimated completion dates will be established for each project. Timelines may change due to scope changes, delayed feedback, late payments, or circumstances outside our reasonable control.
Ongoing maintenance, updates, security monitoring, technical support, and new features are not automatically included after delivery unless agreed upon in writing.
We make reasonable efforts to deliver work according to the agreed requirements, but cannot guarantee that every website will always be error-free, continuously available, or compatible with every device and third-party service.
12. Cancellations and Refunds
Project cancellations and refund terms will be governed by the applicable project agreement and applicable law.
Where permitted by law, clients may be responsible for work already completed and disclosed, agreed expenses incurred before cancellation. Any refund eligibility, cancellation charges, or delivery of unfinished work will be handled according to the agreed terms.
Nothing in this section removes any refund or cancellation rights that cannot legally be waived.
13. Limitation of Liability
To the maximum extent permitted by applicable law, VON Visual Designs will not be liable for indirect, incidental, special, or consequential losses arising from the use of our services, including lost profits, lost revenue, or business interruptions.
We are not responsible for issues caused by third-party services, client-provided materials, or unauthorized modifications made after delivery, except where applicable law provides otherwise.
These terms do not exclude or limit liability where such an exclusion or limitation is prohibited by law.
14. Changes to These Terms
We may update these Terms of Service from time to time. The latest version will be published on this page with an updated date.
Changes apply as permitted by applicable law. Changes to an existing project's agreed terms may require additional written agreement.
15. Subdomain Ownership and Licensing
If the client does not register or provide a custom domain for their website, VON Visual Designs may assign the client a subdomain in the format clientbusinesssname.vonvisualdesigns.com.
The subdomain and the underlying provider domain, vonvisualdesigns.com, are owned and controlled solely by VON Visual Designs. The client receives a limited, non-exclusive, non-transferable license to use the assigned subdomain for their website while the applicable project agreement remains active and all required fees are paid.
The client does not acquire any ownership interest in the assigned subdomain or in any domain owned or controlled by VON Visual Designs. The subdomain remains subject to our administration and applicable service terms.
If the agreement ends or required fees remain unpaid, access to or use of the subdomain may be suspended or discontinued, subject to the project agreement and applicable law. The client is responsible for registering and maintaining a separate custom domain if they want independent control over their domain name.
